Charity organisations. ANO is very close to charitable organizations that are obliged to spend all the funds to support the activities for which the organization was created. The second difference between ANO and other forms is that all the property of such organizations cannot belong to any of the founders. That is, all property rights are assigned only to the organization itself, and the founders (the state, private individuals) have no rights to this property.

Tip one: Check if the center has an educational license?

If there is no such license, then look for another center. Why? Because diplomas issued by institutions without a license are not legitimate, they are fake.

It is necessary to check the relevance of the license on the Rosobrnadzor website. Just enter in the "registration number" field the number that is indicated in the license you are checking.

On the website of the institution in the curriculum section, there should be curricula approved by the organization, where the number of study hours is clearly indicated. If you see that you are offered a program of less than 250 ac. hours, then immediately leave this site.

According to the law, the retraining program cannot be less than 250 hours. Anything less than this figure is already a refresher course. The number of hours must be written on the diploma itself. And if this figure is less, then the diploma of retraining is considered false.

Recall that according to departmental regulations (orders of ministries) for some professions and specialties, special requirements for the number of hours are established. In some - up to 1000 hours. Keep in mind that mastering the program for more than 1000 hours allows you to get not just a diploma of vocational retraining, but also to get a qualification.

Tip three: Check the statutory, organizational and other documents

Pay attention to the year the training center has existed. The older he is, the better. That is, there are fewer options that you will fall for scammers. Specify the address of the institution, whether this center is actually located there. The address must be found out not on the website of this center itself, but through the search services for PSRN and TIN. If you did not find confirmation of the location address, it means that these are scammers.

The most important thing is in the contract with the center itself. The address, PSRN, TIN are registered there. They must match.

You don't have to pay anything without signing the contract. Then just do not return the money if they are scammers.

Tip #4: Check the Availability of Center Staff

Call by phone, write in the chat. Talk to employees and ask uncomfortable questions. If the employee is not ready to answer, then this is a bad signal.

There are times when, after paying under the contract, communication with the center disappears. No one picks up the phone (they blocked the phone number), do not answer letters. Check if the organization has pages on social networks and from what period.

Professional retraining programs developed by the Ministry of Education and Science of Russia as an alternative second higher education. Professional retraining is a convenient, inexpensive and, most importantly, fast way (the program includes only profile disciplines) to get a second education, to master a new specialty. This compares favorably with the second higher education, which lasts 3 years or more, is much more expensive and full of general subjects.

As in the case of programs of basic higher education, entering the specialty of vocational retraining, you can choose any form of education: on-the-job (full-time), on-the-job (evening or remote), with a partial break-off (correspondence) and individual forms of education. The form of professional retraining is established by the educational institution, depending on the complexity of the program.

Similarities of learning formats

Differences in professional development programs

In other words, after completing a refresher course, you can change your profession. But unlike a second higher education, you can change your profession either in the area where you work now, or in one that does not require basic specialized education. Also, professional retraining is necessary in case of a long break in work in a particular specialty.

For example, a specialist in medical massage must have a secondary vocational education in the specialty "Medical massage". If the specialist studied in one of the listed programs of secondary vocational education: "Nursing", "General Medicine", "Obstetrics" or higher education: a specialist in "General Medicine" or "Pediatrics" - he can take a course of professional retraining in the specialty "Medical Massage" and work in the positions of "Massage Nurse", "Massage Nurse", "Masseur". Employees with any other basic education cannot take a retraining course and apply for these specialties.

What is a Postgraduate Diploma?

If a student has mastered the full retraining course, then it is the diploma that becomes the main document with which he can later get a job. Until 2013, a diploma was required for more than 500 hours of training - now there is no such requirement.

Is a retraining diploma a state or standard document?

Currently, people are issued a diploma of professional retraining of the established sample. At the same time, such diplomas are issued by universities and private educational centers. The former law on education, which was in force until 2013, provided for the issuance of state-recognised professional retraining diplomas. However, there were almost no state standards for additional vocational education programs, and in the current version of the law, the wording “state standard” was replaced by “established standard”.

It should be noted that the law equates professional retraining to (documents on their receipt are considered equivalent).

At the same time, it is not forbidden by law if a student undergoes vocational retraining in parallel with the development of the main specialty. In this case, both documents are issued to him after passing the qualifying exams.

What does a professional retraining diploma give?

The holder of a diploma under the law has exactly the same opportunities as a specialist with a standard education. That is, he has the legal right to get a job and engage in specific activities in the profession that is spelled out in the document.

Students who fail the certification, or have expelled and dropped out, are issued only a certificate of study.

How long is a professional retraining diploma valid?

Unlike a certificate of professional development, the validity of which must be periodically renewed, a diploma will always be valid.

By law, qualification documents – including professional retraining diplomas – are designed for a certain period of validity. The Ministry of Education and Science approved recommendations for the preparation of documents on qualifications, according to which such documents indicate only the date of their issue.

2. Retraining (retraining) is organized for the laid-off workers who cannot be used for their existing professions, as well as for the unemployed who have expressed a desire to change their profession, taking into account the needs of production, with the aim of mastering new professions.

Retraining of workers and unemployed citizens is carried out at the educational bases of organizations (training centers, training centers, schools, permanent courses, etc.), in training centers operating as part of the state employment service. In addition, retraining of workers is carried out by primary, secondary and higher educational institutions of vocational education.

Employees undergo retraining (retraining) with and without interruption from work and in the same forms that are used in their training (Article 202 of the Labor Code).

Persons who have lost their jobs undergo vocational training and retraining in non-governmental organizations (educational institutions), whose activities are allowed under licenses issued by executive authorities in the presence of the conclusion of the state employment service.

3. Under the training of workers in the second (related) professions, it is customary to understand the training of people who already have one profession, another profession - with an initial or higher level of qualification. Based on the specific conditions of production, the employer approves a list of second (related) professions for which training is provided, taking into account the opinion of the representative body of employees (Article 196 of the Labor Code). Forms of training for second (related) professions, the procedure for developing and approving curricula and programs, completing training are similar to those used in the retraining (retraining) of employees.

4. The goal of the Government of the Russian Federation and other government bodies, as noted in the Main Directions for Training Personnel for a Market Economy, approved by the Decree of the Council of Ministers - the Government of the Russian Federation of November 4, 1993 N 1137 * (2), is "the formation in cooperation with business structures and public associations of the personnel corps, capable of effectively solving the problems of creating a market economy, updating the social structure of society.

These are fundamentally new requirements for managers and specialists of the organization, for the content of their training and retraining. They are implemented through continuous training of these categories of workers.

Continuity of training of the personnel corps is provided by the following types:

Systematic self-training of an employee (self-education) according to an individual plan approved by his immediate supervisor and carried out under his supervision;

Participation at least once a month in permanent seminars on production and economic issues both at the place of work and in other organizations;

Short-term (as needed, but at least once a year) training at the place of work or in educational institutions (divisions) of the system of advanced training and retraining of personnel;

Long-term periodic training (at least once every five years) in educational institutions (divisions) of the system of advanced training and retraining of personnel;

Internships in leading organizations, in leading scientific organizations, in educational institutions of higher professional education, including abroad;

Education in the target postgraduate, doctoral studies on topics of interest to this organization;

Retraining - obtaining a new specialty in academies, advanced training institutes, intersectoral regional centers for advanced training and retraining, employment service training centers, as well as in structural subdivisions for advanced training and retraining of educational institutions of higher and secondary vocational education.

Professional retraining of specialists is organized with the aim of obtaining additional knowledge, skills and abilities in educational programs that provide for the study of individual disciplines, sections of science, engineering and technology necessary to perform a new type of professional activity.

Educational institutions conduct training on the basis of contracts concluded with federal executive bodies, organizations of all forms of ownership, the state employment service, and other legal entities.

There are several forms of professional retraining of specialists: with a break from work, without a break, with a partial break. An educational institution establishes a form of professional retraining depending on the complexity of educational programs and in accordance with the needs of the customer on the basis of an agreement concluded with him.

The diploma of the established sample is received by students who have fulfilled all the requirements of the curriculum and passed the state final certification. It is not a document of higher or secondary vocational education, but only certifies the right of a specialist to conduct professional activities in a certain area on the basis of the existing higher or secondary vocational education in accordance with the established qualification requirements for job categories of employees (see Regulations on the procedure and conditions for professional retraining specialists, approved by order of the Ministry of Education of Russia dated September 6, 2000 N 2571 * (3)).

5. Professional development of workers is understood as training designed to consistently improve their professional and economic knowledge, skills and abilities, to improve skills in existing professions. It is held at production and economic courses, special-purpose courses, courses for foremen, at schools of advanced techniques and methods of work. Professional development of specialists is designed to update their theoretical and practical knowledge in accordance with the ever-increasing requirements of state educational standards.

Advanced training is carried out as necessary, but at least once every five years during the entire working life of employees. Its frequency is set by the employer.

There are the following types of advanced training:

Short-term (at least 72 hours) thematic training on the issues of a specific production, which is conducted at the place of the main work of specialists and ends with passing the appropriate exam, test or defense of the abstract;

Theoretical and problematic seminars (from 72 to 100 hours) on scientific, technical, technological, socio-economic and other problems arising at the level of the industry, region, organization;

Long-term (over 100 hours) training of specialists in educational institutions for advanced training for in-depth study of topical problems of science, engineering, technology, socio-economic and other problems in the profile of professional activity.

In addition to the above, an internship may be included in the curriculum. It is organized with the aim of forming and consolidating in practice professional knowledge, skills and abilities obtained as a result of theoretical training. An internship can also be carried out with the aim of studying best practices, acquiring professional and organizational skills to perform duties in a current or higher position.

The place of training for specialists can be both Russian organizations and foreign enterprises (associations), leading research organizations, educational institutions, consulting firms and federal executive authorities. Based on the objectives of the internship, the employer determines its duration in agreement with the head of the organization where it is held.

Educational institutions carry out advanced training of specialists on the basis of contracts concluded with federal executive bodies, organizations of all forms of ownership, and the employment service.

The following are recognized as educational institutions for advanced training:

Academies (with the exception of academies that are educational institutions of higher professional education);

Institutes for advanced training (institutes for improvement) sectoral, intersectoral, regional, organized in (at) educational institutions of higher professional education;

Courses (schools, centers) for advanced training, training centers of the employment service, in which specialists, unemployed citizens, the unemployed population and the released employees of enterprises (associations), organizations and institutions are trained in order to gain new knowledge and practical skills necessary for professional activities.

Training can also be carried out by structural subdivisions of advanced training of educational institutions of higher education (faculties for advanced training of teachers and specialists, intersectoral regional centers, etc.) and secondary vocational education (training courses for specialists of enterprises).

Students who have successfully completed the course of study, state, as well as accredited non-state educational institutions for advanced training, issue the following state documents:

The regulation of the professional training of civil servants is carried out by a special act: the Regulations on the advanced training and retraining of federal civil servants dismissed from the apparatus of state authorities of the Russian Federation in connection with the liquidation or reorganization of these bodies, the reduction of staff, approved by Decree of the President of the Russian Federation of August 23, 1994 N 1722*(5) .

7. The question arises: who bears the costs of training laid-off workers? For a long time, these costs were levied from organizations (from which employees were laid off) on the basis of par. 2 p. 4 of the Decree of the Government of the Russian Federation of May 14, 1992 N 315 "On the system of vocational training, advanced training and retraining of laid-off workers and the unemployed population" * (8) .

Consequently, the arguments of the representative of the Government of the Russian Federation on the conformity of the disputed resolution with the Law of the Russian Federation "On Employment of the Population in the Russian Federation" are untenable.

At the court session, a representative of the Government of the Russian Federation explained to the court that the rule on reimbursement by employers to the State Employment Fund of the costs of training workers released from enterprises is a sanction for employers’ failure to fulfill their obligation to create conditions for professional training, advanced training and retraining of workers.

Meanwhile, the court believes that by virtue of paragraph 2 of Art. 3 of the Civil Code of the Russian Federation, the civil (property) liability of employers can only be established by federal law, and not by a decree of the Government of the Russian Federation.

In connection with the foregoing, the court cannot agree with the argument of the representative of the Government of the Russian Federation that the contested norm can be established by the Government of the Russian Federation in accordance with paragraph 1 of Art. 6

Thus, in deciding whether to apply par. 2 p. 4 of the Decree of the Government of the Russian Federation of May 14, 1992 N 315, final clarity was introduced.
