The purpose of state accreditation of educational activities. State accreditation of educational institution

In order for an institution to confirm the compliance of its educational activities with state standards, state accreditation and licensing of an educational institution is carried out.

It is declaratory and not mandatory. Having a special permit, an institution can conduct educational activities without undergoing state accreditation. But, having passed it, the organization confirms that its activities meet the requirements of the Federal State Educational Standard.

State accreditation is carried out for the main educational programs of the Federal State Educational Standard, as well as for vocational education programs. Programs are not subject to state accreditation.

Application for state accreditation of an educational institution

The first stage of accreditation is the submission of an application to the accreditation body accompanied by a rather voluminous package of documents. To find out what requirements apply to the application and documents, you need to refer to the Regulations on State Accreditation, approved. Decree of the Government of the Russian Federation dated November 18, 2013 No. 1039 “On state accreditation of educational activities” (hereinafter referred to as the Regulations on state accreditation).

The next stage of state accreditation of an educational institution (hereinafter - OU) is accreditation examination. At this stage, it is checked to what extent the content and quality of students’ training at the educational institution complies with the Federal State Educational Standard.

The examination is carried out by a group of experts (at least two people), who must be accredited in accordance with the procedure determined by the regulations of the Ministry of Education of the Russian Federation and meet the qualification requirements. Officials of the accreditation body cannot participate in the examination due to a conflict of interest.

After the examination, the group of experts submits a report. The expert opinion is prepared by the group leader. The conclusion should contain a number of information:

  • date of execution of the expert group’s conclusion;
  • full name of the organization and branch (if any);
  • information about the materials submitted by the organization;
  • a report on the content and quality of students’ training with a conclusion about compliance or non-compliance with educational institution standards.

The accreditation examination is carried out with an on-site expert group, but there may also be a non-traveling examination if the organization is a foreign institution; if the organization’s activities are carried out by a Russian educational organization located outside the Russian Federation; or, if implemented by an organization created outside the territory of the Russian Federation or a foreign organization carrying out activities outside the territory of the Russian Federation.

In case of non-compliance of an organization with educational standards, copies of documents certified by the organization confirming this non-compliance are attached to the report of the expert group. This fact may be grounds for refusing to grant state accreditation to an educational institution.

Within three working days from the date of receipt of the expert group’s conclusion, a copy of it is sent to the educational organization or submitted for signature and posted on the official website. The conclusion of the expert group is reviewed by the accreditation body and only after that a decision is made on the compliance or non-compliance of the content and quality of training. Upon successful completion of state control, the educational institution is issued a certificate of state accreditation of educational activities.

The issued certificate confirms the state status of the educational organization and the compliance of the quality of services provided with state education standards. An appendix must be attached to the certificate, which indicates the educational institution data, levels of education, accredited educational programs, etc. Without the appendix, the certificate is considered invalid.

Refusal to state accreditation of an educational institution occurs in cases of provision of false information or the presence of a negative conclusion based on the results of the examination. If accreditation is refused, the educational institution may re-apply with a similar application, but not earlier than after 12 months.

Validity period of state accreditation of an educational institution

A certificate of state accreditation for organizations implementing basic professional programs is issued for 6 years, for 12 years - for organizations implementing basic general education programs. Rosobrnadzor explained that if an organization implements both programs and applies for state accreditation, then if the decision is positive, two certificates will be issued - one for 6 years, the other for 12 years.

Within 10 working days from the date of a positive decision, the accreditation body issues a certificate or sends it by registered mail to the organization.

Moreover, professional and general education programs can be accredited in the absence of students completing their studies in the current year. At any stage, the educational institution can apply for state accreditation - in the first, second or third year.

Re-issuance of a certificate

The procedure and grounds for re-issuing a certificate are established by the Regulations on State Accreditation.

The certificate must be reissued by those organizations that were created through reorganization as part of an affiliation or merger if they have a certificate of state accreditation of the affiliated institutions. The certificate will be issued upon joining - for the period until the expiration of the certificate of the reorganized organization; in case of a merger - for the period until the expiration of the certificate of the reorganized organization, the validity of which expires earlier.

Temporary certificate

According to the norms, a temporary certificate is issued only to those institutions that arose as a result of reorganization in the form of division or separation. It is issued for one year so that the educational institution can prepare all the documents and in a year undergo state accreditation for the period that corresponds to a particular program.

Deprivation of an educational institution of state accreditation

The decision to revoke state accreditation is made by the accreditation body on the basis of the law on education. The reason may be a repeated violation of legislation in the field of education or the expiration of the suspension of state accreditation in the absence of grounds for its renewal.

If the license to carry out educational activities is terminated, the state accreditation of the educational institution is terminated from the date of the decision to terminate the license.

Recently, increased attention has been paid by Rosobrnadzor and the Ministry of Education to the quality of education in universities. Inspections and constant monitoring of the educational process are carried out.

Based on the analysis of various data, recommendations are made to stop the work of ineffective and low-quality educational institutions. The license and accreditation of such a university (college, school) is revoked

However, often the management of such organizations is in no hurry to notify their students about this and continue to conduct educational activities. Moreover, they continue to recruit students and accept tuition fees, taking advantage of the ignorance of applicants about the true state of affairs at the institute.

In order to avoid getting into such a situation when choosing a university upon admission, the first thing applicants should pay attention to is the availability of a license to conduct educational activities and accreditation.

Since 2011, licenses began to be issued for an indefinite period, but this does not mean that they cannot be revoked. Scheduled inspections of Rosobrnadzor are carried out no more often than once every three years (this must be kept in mind). But if complaints and requests arise, the frequency of inspections is not limited.

Key points to pay attention to:

  • The name of the university in the license must match the name in all documents, orders, contracts, certificates of the university, including the diploma.
  • The university address indicated in the license is the legal address and may not coincide with the place of your study. The main thing is that this address must coincide with the address specified in the University Charter and in the agreement for the provision of paid educational services.
  • The license has an application - one or more. The applications indicate the educational programs in which the university has the right to teach, so you should pay attention to this when choosing a university and the specialty in which you want to study. The applications recently issued using the new form also indicate the places of educational activities.

By Decree of the Government of the Russian Federation dated November 18, 2013 No. 1039, a new Regulation on state accreditation of educational activities (hereinafter referred to as the Regulation) was approved. Accordingly, the previous regulatory legal documents on state accreditation of educational activities from this moment lose force.

It is important to note that, according to this Resolution, certificates of state accreditation that organizations carrying out educational activities have, issued before September 1, 2013, are subject to re-issuance by accreditation bodies before January 1, 2016, based on applications from these organizations.

10. For the issuance of a certificate (temporary certificate), a state fee is paid in the amounts and in the manner established by the legislation of the Russian Federation on taxes and fees.

11. The regulation also establishes the grounds and procedure for reissuing the accreditation certificate, issuing a duplicate in the event of loss or damage to the certificate with an attachment, the procedure for suspension, renewal, termination and deprivation of state accreditation.

The concept of "accreditation" has Latin roots. Literally translated, it means “to place trust.” In the modern world, this term is considered as an established standard, recognition of a special status (powers). Let us consider further how accreditation of educational institutions is carried out, what it is and what laws it is regulated by.

Regulatory framework

At the end of 2010, Federal Law No. 293 introduced a number of changes to some legislative acts. This need arose in connection with the improvement of supervisory and control functions. The changes are aimed at optimizing the provision of educational services. As a result, a special procedure was introduced for the relevant institutions. From that moment on, accreditation and certification of educational institutions and scientific organizations began.

Subjects

According to accepted legislative norms, accreditation and certification of educational institutions is carried out regardless of their types and types. However, there is an exception to this rule. The provisions of the law do not apply to preschool educational institutions and institutions for additional education of children. All other organizations providing training programs in accordance with the Federal State Educational Standard, federal requirements and legal provisions are required to undergo a compliance procedure.

Important point

In some institutions there is a program that implements the program. The question arises: are they subject to the requirement to undergo a mandatory procedure for confirming compliance? In this case, state accreditation of an educational institution is carried out without including these programs in the audit. To implement them, however, you must have permission. This is a license, which, in fact, allows the institution to operate in accordance with preschool education programs. In addition, the new rules stipulate the situation with organizations providing additional services in the area in question. In particular, we are talking about palaces of youth/children's creativity, children's art schools, children's sports schools, etc. Accreditation of educational institutions of this type is not carried out.

Payment

In accordance with Federal Law No. 293, a state duty was introduced for the accreditation of an educational institution. It replaces payment for procedures, including under contracts with specialized organizations for the provision of information and methodological services. The amount of payment is established by Art. 333.33 Tax Code. Thus, formally, in legal terms, state accreditation of an educational institution has become free, since it relates to services provided at the expense of budgetary funds.

Payment amount

The legislation establishes the following amounts:

  • For higher professional institutions - 130 thousand rubles. Additionally, it will be necessary to pay 70 thousand for each expanded group of directions in the organization itself and its branches, included in the certificate of accreditation of the educational institution.
  • Institutions implementing additional professional programs - 120 thousand rubles.
  • Institutions of secondary vocational education - 50 thousand rubles.
  • Institutions of primary vocational training - 40 thousand rubles.

Accreditation of other types - 10 thousand rubles. When changing the status and re-registration of the saint, you must pay from 3 to 70 thousand rubles. In the case of accreditation of educational programs, expanded groups of specialties, the amount for replacing a certificate is set at 7 to 70 thousand rubles. In other cases, including for the issuance of a temporary certificate, you need to pay 2 thousand rubles. It should be said that replacing payment with a fixed budget payment does not mean that the institution is deprived of the right to independently conclude contracts with organizations that prepare for accreditation of an educational institution.

New rules

Considering the requirements for accreditation of an educational institution, special attention should be paid to curriculum. First of all, this applies to primary, secondary and higher professional institutions. Such institutions are issued a certificate not for individual programs, but for expanded, enlarged categories of areas, which are determined by the accreditation body. This allows you to change or supplement specific projects without submitting them to the authorized structure. That is, adjustments are made based on the license.

Additionally

According to Art. 33.2 of the Law “On Education”, the right to state accreditation of a program belongs to educational institutions in which there are students studying or completing training in it in the current year. As before, the possibility of carrying out the procedure step by step (in accordance with the steps) is provided. That is, educational institutions are accredited in relation to certain programs of primary, basic and secondary general (full) education.

Self-examination procedure

Accreditation of educational institutions includes self-assessment by institutions of their activities. Previously, the self-examination procedure was provided primarily for universities. The rules by which self-assessment is carried out are formulated and approved by the executive federal body, whose powers include the development of state policy and legal regulation of the education sector.

Expertise

Licensing and accreditation of educational institutions require the implementation of certain procedures confirming the compliance of the quality and content of programs acquired by students and graduates in accordance with the Federal State Educational Standard. In addition, an examination of the educational institution’s performance indicators is carried out. They are necessary when determining the type and type.

Performance indicators

Their list is introduced at the federal level. indicators by which the type and type of educational institution is determined must be established by the accreditation body. For example, regarding schools, such a structure is a regional department, ministry or other management institute. Of course, they should be involved in the field of education. The established list of indicators must be agreed upon with the Ministry of Education and Science. The procedure for determining their criteria is approved by the Government.

Documents for accreditation of an educational institution

In accordance with the regulations, the procedure involves several stages. First of all, the head of the educational institution performs an analysis of its activities. Based on the results, a self-examination report is compiled. After this, an application and documents are sent to the department (division) of the authorized body for accreditation of the educational institution for the relevant programs:

  • charter;
  • plans for all approved programs applied for accreditation;
  • the main professional program of postgraduate education (if it is present at the educational institution);
  • regulations on the branch of the institution (if there is such a division).

2. Report on the results of self-assessment.

Licensing and accreditation of educational institutions involves the issuance of relevant papers. When sending programs for compliance verification, the OU also provides copies of the permit and certificate. An integral document is also an inventory of the submitted papers. Copies of the charter, regulations on the branch, permission and certificate must be certified by a notary. Copies of the remaining papers are certified by the OS. In addition, you must attach a receipt confirming payment of the fee.

Shipping method

The above documents can be sent on paper. In this case, it is allowed to present them in person or by post (registered mail). Documents can also be submitted electronically. In this case, you should use the unified service portal. If papers are sent this way, they must be certified by an electronic signature.

Statement

Accreditation of educational institutions is carried out upon appropriate application. The application should indicate:

  1. Full name, legal form and location of the institution according to the charter.
  2. Name and address of branches (if necessary).
  3. Registration state number of the entry on the formation of a legal entity and information from the document that confirms the fact of entering information about the created organization into the Unified State Register of Legal Entities.
  4. TIN and information about registration with the tax service.
  5. Details of the existing accreditation certificate.
  6. State status (type and type) of the educational institution.
  7. List of programs applied for accreditation.

Solution

Within 7 days, the accreditation body sends the educational institution or hands its representative a notification that the documents have been accepted for consideration. If the papers are not provided in full or some of them are filled out incorrectly, the authorized authority sends a notice with the corresponding list. 2 months are given to correct errors and provide missing copies of the OU.

Public accreditation of educational institutions

This procedure is also provided for at the legislative level. The right to conduct it was granted back in 1992. Currently, experts note the expansion of the subject of regulatory regulation in the field of public accreditation. The legislation enshrines not only the right itself, but also explains in detail the concept of the procedure and establishes the responsibilities of organizations authorized to carry it out. The key task of such structures is to ensure accessibility and openness of information.

Specifics

Public accreditation of educational institutions is carried out on the initiative of the institutions themselves. The legislation places special emphasis on the voluntary nature of the procedure. This means that at the regulatory level it is prohibited to force educational institutions to obtain such accreditation by government agencies, local structures and legal entities authorized to carry it out. The law also does not establish the need for agreement with the founder to carry out this procedure.

Authorized Subjects

The right to perform public accreditation is recognized for different organizations. Thus, according to the law, it can be carried out by both domestic and international and foreign entities. At the same time, only public organizations are indicated in the norms as authorized persons. However, this limitation is not consistent with the definition of the procedure itself in the law. It should be noted here that the Federal Law “On Education” approves only the basics of public accreditation. In more detail, all relations that arise in this area are regulated by acts adopted directly by the authorized structures themselves.

Procedure

The procedure is implemented in the form of the following activities:

  1. Expert assessment in the institution.
  2. Discussion of the results obtained.
  3. Making a decision on passing or extending or refusing public accreditation of the educational institution.
  4. Inclusion of the establishment in the relevant register (that have passed the procedure).
  5. Providing the institution with a certificate in the prescribed form.
  6. Written notification to the executive federal body for supervision and control about the results of the procedure.

Criteria and indicators

They are established directly by the organization that performs accreditation. When assessing the quality of organization and provision of the educational process, the following is assessed:

  • Compliance of plans with implemented programs.
  • Availability of regulatory support.
  • Compliance of the organizational system of the educational institution.
  • Quality of the educational process.
  • Compliance of work programs with the content of training plans.
  • Level of provision with teaching materials.
  • Opinions of employees, graduates, students, employers about the quality of the learning process, and so on.

Personnel availability

This criterion is used to check the compliance of the professional level of the teaching staff with the disciplines taught. The share of full-time specialists, including those with a degree, engaged in the training process is also established. An important criterion is the correspondence of the number of teachers to the number of disciplines taught at the educational institution.

Material and technical support

According to this criterion, the accreditation organization determines the correspondence of the number of premises for conducting the established types of classes to the number of students. Checking the technical equipment and general condition of the offices is of no small importance. The educational institution must have sufficient infrastructure to ensure the implementation of educational programs.
