3. Within the territory of a moderately dangerous landslide zone, the placement of objects specified in Part 2 of this article, as well as objects related to objects of special-purpose zones, is permitted.

The placement within the boundaries of a moderately dangerous landslide zone of objects specified in paragraph two of part 2 of this article, as well as objects related to residential, public and business zones, is permitted subject to the implementation of measures to reduce geological risk.

4. Potentially within the territory danger zone The placement of any objects is permitted subject to the implementation of measures to reduce geological risk.

5. Provision land plots citizens and legal entities carried out in compliance with the provisions of this Law. In the decision executive body state power The Republic of Ingushetia, which has the right to provide land plots, must indicate the implementation of appropriate measures to reduce geological risk.

6. The restrictions established by parts 1-3 of this article relate to restrictions on the use of land plots and other real estate objects subject to state registration in the manner established by law on state registration of rights to real estate and transactions with it.

Article 5. Measures to reduce geological risk

1. Measures to reduce geological risk are organizational, engineering, technical and other measures aimed at eliminating or reducing the factors that determine the development and activation of hazardous natural processes.

2. Measures to reduce geological risk include:

1) within a very dangerous zone: special engineering training territory, including the development and implementation of a set of preventive and emergency landslide measures and other activities;

2) within the danger zone: measures to create drainage systems, drainage engineering networks, collection and disposal of surface and storm water, waterproofing of buildings and structures, planning and securing sections of slopes, maintaining underground communications in technically sound condition and other measures;

3) within a moderately dangerous zone: measures to eliminate conditions for excessive watering of the territory, backwater of pound water or disruption of underground flow (raising the water level in open reservoirs, pits, barrage effects, filling the valleys of small rivers and ravines), pruning, increasing the steepness or excessive loading of slopes. Within the moderately dangerous zone, if necessary, engineering protection measures are also carried out, including the creation of drainage systems, drainage of surface and storm water, phytomelioration of slopes, maintenance of water-carrying communications and other measures;

4) within the boundaries of a potentially dangerous zone: measures to prevent excessive moisture in the territory in order to eliminate the formation of perched water, trimming slopes, eliminating natural drains, as well as constructing devices for collecting and draining surface and storm water, phytomelioration of slopes, maintaining water-bearing bodies in proper condition communications and other events.

3. Mandatory measures to reduce geological risk within very dangerous, dangerous, moderate and potentially dangerous landslide zones include: organization of a system of comprehensive monitoring of the geological environment, including exodynamic monitoring of vertical and planned changes in the position of landslide bodies and soil masses, hydroecological monitoring of levels groundwater, their composition and dynamics, as well as observations of buildings, structures and underground communications, which make it possible to judge the deformations of their foundations.

Monitoring of landslide zones is carried out by specialized organizations.

The results of monitoring landslide zones are the basis for adjusting the approved boundaries of landslide zones.

Article 6. Liability for violation of this Law

For violation of the provisions of this Law, the perpetrators are held accountable in cases and in the manner provided for by the legislation of the Russian Federation.

Article 7. Final provisions

1. From the moment this Law comes into force and the boundaries of landslide zones are approved, changes to existing real estate objects, as well as the construction of new objects in landslide zones, the placement of which is prohibited by this Law, are not allowed. In relation to land plots and other real estate located at the time of adoption of this Law within landslide zones, appropriate measures to reduce geological risk are subject to implementation, if necessary.

2. The Government of the Republic of Ingushetia should bring its regulatory legal acts in accordance with this Law.

Article 8. Entry into force of this Law

This Law comes into force on the date of its official publication.
